CENTER POINT, Ala. --- The family of a children injured in a fatal crash in Center Point have filed a lawsuit against the suspect in the accident.
The grandfather and aunt filed the claim Monday afternoon, citing negligence against 19 year old Josephy Alexander Goolsby from Pinson.
The mother who delivered her baby hours after being critically injured in the crash, has died.
The Jefferson County Sheriff's Office has confirmed that 27 year old Yasmine Aguilar passed away Sunday.
She delivered a baby hours after being involved in a crash in the 1300 Block of Center Point Parkway around 12:45 a.m.
The baby is currently in stable condition.
Investigators claimed Aguilar, her husband and two children were hit from behind by 19 year old Joseph Alexander Goolsby from Pinson.
The husband, Edgar Gabriel Perez of Fultondale, died and the children were transported to Children's Hospital.
At last check, the 11 year old child was in critical condtion, but there was no information on the 8 year old.
Goolsby has been arrested and vehicular homicide charges are pending against him, according to Chief Deputy Randy Christian.
Christian said Goolsby had a blood alcohol level above the legal limit at the time of the collision.
In lawsuit, the family's lawyer is citing permanent injury to all three surviving children, inlcuding the newborn.
They are demanding a jury trial and requesting financial damages against Goolsby, who has not filed a response.
