BIRMINGHAM, Ala. --- Gregory John Katopodis has asked a federal judge for a new trial following Wednesday' conviction on 97 fraud charges.
Attorney Jim Parkman filed the request Thursday in federal court.
Judge Karon Bowdre quickly denied the motion for state reasons she had rejected his motion for acquittal during the trial.
Wednesday a jury convicted Katopodis of using a children's computer charity as his personal piggy bank.
In the motion, Parkman argued the prosecution did not present sufficient evidence of Katopodis' guilt of establishing a scheme to defraud.and claimed defense attorneys were not allowed to refer to cash katopodis deposited in charity's account as 'John's money'.
Katopodis faces 20 years in prison for each of the 97 charges at his October 28 sentencing.
