Jefferson County District 1 Seat

Court justices heard arguments in Montgomery today. At issue - did Jefferson County have the authority to hold a special election... which councilman William Bell won or will Governor Bob Riley's appointee, George Bowman get to keep the seat?

The arguments were straight forward, the justices asked a lot of tough questions - and each side came away from today's arguments believing he or she will win. The arguments were heard by the State Supreme Court's eight justices at Faulkner University's School of Law in Montgomery. About a hundred people sat in the audience, including George Bowman and William Bell to hear the arguments. While a half dozen attorney's argued their cases before the court - at the center of the hearing appeared to be a 31 year old Jefferson County act - that allowed the commission to call a special election for a vacated commission seat.

Ken Wallace/Governor's Legal Advisor said, "It is my belief that the court will find that the local act in Jefferson County was unconstitutional. Everything in this case relates back to that one fact."

William Bell/Won Special Election said, "In the 2007 act of the legislature, they empowered the 1977 act that requires an election to be called by special permission of the election commission."

George Bowman/Appointed Commissioner said, "There's clearly some ambiguity in the law that's why it had to come all the way up before the Supreme Court."

After several hours of arguments - the state supreme court ended it's session and said it would takes today's information under advisement - and rule at a later date.
