BIRMINGHAM, Ala. (AP) -- The state of Alabama is asking a federal judge to throw out a lawsuit that challenges Alabama's property tax system for funding public schools.
The lawsuit was filed in Birmingham in March on behalf of some public school students. Lawyers for the governor and state revenue commissioner say the lawsuit would require a massive intrusion of the federal courts into Alabama's tax structure.
The plaintiffs have until Friday to respond to the state's request for U.S. District Judge Lynwood Smith to toss the lawsuit.
