BIRMINGHAM, Ala. --- A court-appointed attorney for 16 year old Pierre Smith who is accused in a double murder at a Birmingham nightclub said his client told him he didn't pull the trigger.
Mitch Damsky was appointed to represent Smith at a First Call hearing in Jefferson County Criminal Court Wednesday morning.
Damsky said he met with his client for about an hour in the jail following the hearing.
He told NBC13HD his client claimed he was being pummeled when he heard shots being fired.
Damsky said Smith received about 50 stitches around his ear because someone hit him in the back of the head with a beer bottle Saturday morning.
Smith is accused of murdering 20 year olds Willie Daniels and Jason Showers along with shooting two others at Banana Joe's nightclub on Birmingham's southside around 3:00 a.m. Saturday.
Smith told Damsky the 16 year old had been to club before and employees never questioned his age before letting him in.
Damsky claimed his client did not know any of the victims and had gone to the club with his brother and some friends.
Smith also claimed he asked for a lie detector test and a gun residue test when he arrived a the jail, but neither was administered.
Smith's preliminary hearing is set for July 24th at 10:00 a.m. where a judge will decide if there is enough probable cause to bind the case over to the grand jury.
